What DMV Documents Need to Be Notarized?

DMV Documents That Require Notarization in California

If you have ever bought or sold a car privately in California, you know the DMV paperwork can be confusing. Some documents need a notary signature before the DMV will accept them. Others do not. Knowing the difference saves you time, money, and frustration.

As a certified notary serving Sacramento and surrounding areas, I help clients with DMV notary needs every week. Here is a straightforward breakdown of what requires notarization and what does not.

Vehicle Title Transfers (REG 227)

This is the most common DMV document that needs notarization. When you sell or gift a vehicle in California, the title (pink slip) must be signed by both the buyer and seller. If the signatures were not completed in person at the DMV, a notarized REG 227 form may be required.

The REG 227, also called the Application for Duplicate or Transfer of Title, needs notarization when:

  • The seller is not present at the DMV
  • The title is being mailed in
  • A lienholder is releasing interest in the vehicle

When a Title Transfer Does NOT Need Notarization

If both the buyer and seller appear together at a DMV office with valid identification, notarization is typically not required. The DMV clerk can verify identities on the spot.

Power of Attorney for Vehicle Transactions (REG 260)

The REG 260 allows someone to act on your behalf for DMV transactions. This form must be notarized. It is commonly used when:

  • You are out of state and need someone to handle a title transfer
  • A dealer is completing paperwork on behalf of a buyer or seller
  • A family member is handling DMV business for an elderly or incapacitated relative

This is one of the most time sensitive DMV documents I notarize. People often need it done quickly because a sale is pending or a registration deadline is approaching.

Statement of Facts (REG 256)

The REG 256 is a general purpose DMV form used to explain circumstances around a vehicle transaction. It may require notarization depending on the situation. Common uses include:

  • Explaining a discrepancy in the odometer reading
  • Clarifying why a signature is missing from a title
  • Documenting that a vehicle was a gift

Not every REG 256 needs notarization. Check with the DMV or ask your notary to confirm before your appointment.

VIN Verification (REG 31)

When a vehicle is brought into California from another state, the DMV may require a VIN verification. While the verification itself is performed by an authorized VIN verifier (which can include certain notaries), the form may need notarization depending on the circumstances.

Some notaries in California are also authorized VIN verifiers. I recommend confirming this with your notary before scheduling.

Affidavit of Non Dealer Transfer

If you are transferring a vehicle and want to avoid use tax, you may need to file an affidavit proving the transfer qualifies for an exemption. These affidavits typically require notarization. Common exemptions include:

  • Transfers between family members
  • Gifts where no money changed hands
  • Transfers due to inheritance

Lien Sale Documents

When a vehicle has been abandoned or left at a repair shop, California law allows the shop or property owner to pursue a lien sale. Several documents in this process need notarization, including the Lien Sale Authorization and related affidavits.

Tips for Getting DMV Documents Notarized in Sacramento

Bring Valid ID

California law requires government issued photo identification for notarization. A valid driver's license, state ID, or passport works. Expired IDs are not accepted.

Know What You Are Signing Before the Appointment

Do not sign any documents before meeting with your notary. All signatures must be made in the notary's presence. However, you should read and understand the documents beforehand.

All Parties Must Be Present

If a document requires multiple signatures (like a title transfer), all signers must appear before the notary. California does not allow one person to sign for another without a properly notarized power of attorney.

Ask About Mobile Notary Service

California Notary Fees for DMV Documents

California sets a maximum notary fee of $15 per signature. This is consistent regardless of the type of document. Travel fees may apply for mobile notary appointments but are always disclosed upfront.

Common Mistakes to Avoid

Signing before seeing the notary. If you already signed the document, I cannot notarize it. You will need to obtain a new form and sign it in my presence.

Using white out or making corrections. Any alterations to DMV documents can cause them to be rejected. Start with a clean form if you make an error.

Forgetting a required signer. If both the buyer and seller need to sign, both must be present. Plan ahead.
